By visiting our website, submitting an estimate request, signing a project agreement, or hiring us for any work, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1 Services Offered
HighRise Painting LLC provides residential and commercial painting, remodeling, and related services in Memphis, Tennessee and the surrounding Greater Memphis area, including but not limited to:
- Interior and exterior painting
- Cabinet painting and refinishing
- Commercial painting
- Kitchen remodeling
- Bathroom remodeling
- Whole-home remodeling and renovation
- Drywall repair and installation
- Flooring installation
- Trim and finish carpentry
All services are subject to availability, project scope review, and a signed written agreement between HighRise Painting LLC and the client.
2 Estimates & Quotes
Estimates provided by HighRise Painting LLC — whether by phone, email, online form, or in-person walkthrough — are free of charge and carry no obligation.
- All estimates are based on the scope of work described at the time of assessment. Changes to scope may affect the final price.
- Written estimates are valid for 30 days from the date issued, unless otherwise stated.
- An estimate is not a contract. Work does not begin until a written project agreement is signed and any required deposit is received.
- We reserve the right to decline any project at our sole discretion.
Material costs, supply availability, and labor rates are subject to change. If significant time passes between your estimate and project start, we may need to issue a revised quote.
3 Project Agreements & Contracts
Before any work begins, HighRise Painting LLC will provide a written project agreement outlining:
- Detailed scope of work
- Materials to be used
- Project timeline and start date
- Total price and payment schedule
- Any exclusions or conditions
Both parties must sign the agreement before work commences. The signed agreement, together with these Terms of Service, constitutes the full agreement between you and HighRise Painting LLC for the project described.
In the event of any conflict between the signed project agreement and these Terms, the signed project agreement shall prevail.
4 Payment Terms
Deposit
Most projects require a deposit prior to the start of work. The deposit amount will be specified in your project agreement, typically ranging from 25% to 50% of the total project cost depending on scope and materials required.
Progress & Final Payments
Larger projects may be billed in installments tied to project milestones as outlined in the project agreement. Final payment is due upon project completion and client walkthrough approval.
Accepted Payment Methods
We accept cash, check, and major credit/debit cards. Payment method options will be confirmed at the time of agreement signing.
Late Payments
Payments not received within 10 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. HighRise Painting LLC reserves the right to pause or suspend work on any project with an overdue balance.
Returned Checks
A fee of $35 will be charged for any returned or dishonored checks, in addition to any bank charges incurred.
We do not begin any project — including ordering materials or scheduling crew — until the signed project agreement and required deposit are received.
5 Scheduling & Access
Clients agree to provide HighRise Painting LLC with reasonable access to the property on the agreed project dates and during agreed working hours, typically Monday through Saturday, 7:00 AM to 6:00 PM, unless otherwise arranged.
- If access is denied or delayed on a scheduled work day, HighRise Painting LLC may charge a re-mobilization fee or adjust the project timeline.
- We will make reasonable efforts to protect your property, furniture, and belongings. Clients are responsible for removing or covering valuables, breakables, and items not identified as being protected in the project agreement.
- Weather conditions may affect exterior projects. We will communicate any weather-related delays promptly and reschedule at no additional charge.
- HighRise Painting LLC reserves the right to reschedule due to crew illness, supply delays, or other unforeseen circumstances. We will provide as much notice as possible.
6 Changes & Additional Work
Any changes to the agreed scope of work — including additions, deletions, or substitutions — must be agreed upon in writing before the change is made. Change orders will specify the impact on price and timeline.
- Verbal agreements to change scope are not binding. All changes require a written change order signed by both parties.
- Work discovered during the project that was not visible or accessible during the initial estimate (e.g., hidden rot, structural damage, mold) may result in additional charges. We will notify you before proceeding with any such additional work.
- Client-requested upgrades to materials or finishes will be priced and confirmed in writing before being applied.
7 Client Responsibilities
To ensure a smooth project, clients agree to:
- Provide accurate information about the property and any known conditions (e.g., lead paint, asbestos, moisture issues, structural concerns)
- Clear the work area of furniture, décor, and personal items as specified prior to the project start date
- Ensure utilities (electricity, water) are active at the property during the project
- Be available or designate an authorized representative to communicate decisions during the project
- Conduct the final walkthrough promptly upon project completion so any touch-ups can be addressed before the crew demobilizes
- Make payments on time per the agreed schedule
HighRise Painting LLC is not responsible for delays or additional costs caused by the client's failure to meet these responsibilities.
8 Warranty
Workmanship Warranty
HighRise Painting LLC warrants that all work will be performed in a professional and workmanlike manner. We provide a 1-year workmanship warranty on painting services and a 1-year workmanship warranty on remodeling services from the date of project completion.
This warranty covers defects in workmanship such as peeling, flaking, or premature paint failure caused by improper application. It does not cover:
- Normal wear and tear
- Damage caused by the client, third parties, or extreme weather events
- Paint failure due to moisture, structural movement, or pre-existing conditions not disclosed at the time of estimate
- Color fading due to sun exposure (governed by manufacturer warranties)
- Damage resulting from client-applied products or alterations after project completion
Materials Warranty
Materials (paints, coatings, fixtures, flooring, etc.) are covered by the respective manufacturer's warranty. We will assist you in understanding and filing manufacturer warranty claims where applicable.

9 Limitation of Liability
To the fullest extent permitted by applicable law, HighRise Painting LLC's total liability to any client for any claim arising out of or related to our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
HighRise Painting LLC shall not be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of use, loss of income, or loss of profits
- Damage to property not directly caused by our negligence
- Delays caused by factors outside our reasonable control, including weather, supply shortages, or acts of God
Nothing in these Terms limits liability that cannot be excluded under Tennessee law, including liability for gross negligence or willful misconduct.
10 Intellectual Property
All content on the HighRise Painting LLC website — including text, images, graphics, logos, and design — is the property of HighRise Painting LLC or its content suppliers and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works from any website content without our prior written permission.
Project Photography
HighRise Painting LLC may photograph completed projects for use in our portfolio, website, social media, and marketing materials. By hiring us, you grant us permission to use such photographs, provided they do not identify your personal address or private information without your consent. If you prefer we do not photograph your project, please notify us in writing before the project begins.
11 Website Use
By using highrisepaintingllc.com, you agree to use the website only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:
- Submit false, misleading, or fraudulent information through our forms
- Attempt to gain unauthorized access to any part of our website or systems

We encourage clients to contact us directly to resolve any concerns before pursuing formal legal action. Most issues can be resolved quickly through open communication.
If a dispute cannot be resolved informally, both parties agree to first attempt mediation in good faith before initiating litigation. Any legal proceedings shall be brought exclusively in the state or federal courts located in Shelby County, Tennessee, and both parties consent to the jurisdiction of those courts.
Contractor Licensing
HighRise Painting LLC operates in compliance with Tennessee contractor licensing requirements. Any disputes related to contractor licensing may also be directed to the Tennessee Department of Commerce and Insurance, Contractor Licensing.
14 Changes to These Terms
HighRise Painting LLC reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
For active projects under a signed agreement, the Terms in effect at the time of signing shall govern that project unless both parties agree in writing to updated terms.
